Terms of service

Short version: we send reminder texts to a phone number, on a schedule you set, to a person who has personally agreed to receive them. We are not a medical service and not an emergency service. The rest of this page says the same thing more carefully.

The agreement

These terms are between you and [LEGAL ENTITY NAME], a company registered in Croatia ([REGISTRATION NUMBER], [REGISTERED ADDRESS]), which operates Elderflower. By creating an account or using the service you accept them. You must be at least 18 years old.

What Elderflower does

You enter a recipient’s mobile number, the words you want them to receive, and the times and days each message should go out. Elderflower sends those messages by SMS on that schedule, from a number the recipient can save as a contact under a name you choose.

We record the delivery status each mobile carrier reports back and show it to you. Delivery status means a message reached the recipient’s handset. It does not mean they read it, and it does not mean they did what the message suggested. We will never present it as if it did.

The recipient is never required to reply to anything after their initial confirmation. Elderflower does not ask them questions, does not score their answers, and does not report their behaviour to you.

Not an emergency service. Not medical advice.

Elderflower is not an emergency service, a medical device, a monitoring system, or a source of medical advice.

We do not contact emergency services. We do not call 911 or any other emergency number on anyone’s behalf. We do not detect falls, illness, distress, or inactivity, and we cannot tell whether the recipient is safe, awake, or well.

Elderflower is not a substitute for a medical alert device, a care provider, a pharmacist, a doctor, or a person checking on someone in real life. Nothing we send is medical advice, and reminder wording you write is yours, not a clinical instruction from us. If someone may be in danger, call your local emergency number.

Your responsibilities

  • You confirm that the recipient has personally agreed to receive recurring text messages from Elderflower before you enter their number. Your permission is not their permission — theirs is the only one that counts, which is why nothing sends until they reply YES themselves.
  • You enter a number that belongs to that person, and you tell us promptly if it changes hands.
  • You keep reminder wording generic and non-clinical. Do not put a diagnosis, a medication name, or any other health detail into a message. We do not want that information and it should not be sent by text.
  • You do not use Elderflower to pressure, harass, monitor, deceive, or control anybody — including the recipient.
  • You keep your account credentials to yourself, and you are responsible for what happens under your account.

The recipient is always in control

The recipient may reply STOP to any message and all messages end immediately. They may reply START to resume, and HELP for support information. These controls belong to them, work without reference to you, and cannot be disabled from your account. If they opt out, we will tell you that messages have stopped — we will not tell you to talk them out of it.

Delivery is best effort

Text messages travel across mobile networks we do not own. Messages can be delayed, filtered, blocked, or lost — because a phone is off, out of coverage, out of storage, or because a carrier decided so. We cannot guarantee that any individual message is delivered, or delivered at an exact minute.

Mobile carriers are not liable for delayed or undelivered messages. Please do not build a plan around Elderflower where a single missed message would be harmful.

Billing, trial and cancellation

  • Elderflower costs $24.99 per month for one recipient, billed monthly in advance.
  • New subscriptions begin with a 7-day free trial. Your card is not charged during the trial.
  • If you do not cancel before the trial ends, the subscription starts and your card is charged $24.99, then again each month until you cancel.
  • You can cancel at any time from your dashboard. Cancellation takes effect at the end of the period you have already paid for, and reminders stop then.
  • Payments are processed by our payment provider, which acts as merchant of record and handles applicable taxes. Prices are in US dollars.
  • If something goes wrong — a billing mistake, a service failure, a month you never used — email us. We would rather sort it out than argue about it.

Acceptable use

Elderflower is a personal reminder service for one family member. It is not a messaging platform, and using it as one puts the phone numbers of every other family we serve at risk.

  • No marketing, promotional, political, charitable, or fundraising messages of any kind.
  • No content relating to alcohol, firearms, tobacco or vaping, cannabis, gambling, loans, or adult material.
  • No unlawful, deceptive, threatening, hateful, or harassing content.
  • No bulk or automated sending, no reselling the service, and no messaging numbers you were not given permission to message.
  • One recipient per subscription. If you need reminders for two parents, take out two subscriptions.

We may suspend or close an account that breaks these rules, and we will do it immediately if it puts the recipient or our messaging programme at risk.

Availability and changes

We will keep the service running as reliably as we can, but we do not promise uninterrupted availability. We may improve or change features over time. If we change these terms in a way that matters, we will email subscribers before it takes effect; continuing to use Elderflower afterwards means you accept the change.

Liability

Elderflower is provided as is. To the fullest extent the law allows, we are not liable for indirect or consequential loss, and our total liability for any claim is limited to the amount you paid us in the twelve months before it arose. Nothing here limits liability that cannot legally be limited.

Because it matters more than the paragraph above: we are not liable for a health outcome, a missed dose, or an emergency. Elderflower sends a text. Care is done by people.
